MEMORANDUM OF AGREEMENT

Brick Township (“Township”) and Brick Township Policemen’s Benevolent Association Local 230 and the Brick Township Policemen’s Superior Officer’s Association (collectively “PBA”), hereby agree to this Memorandum of Agreement, dated August 8, 2011, with respect to a successor collective bargaining agreement between the parties. This agreement is subject to ratification of the parties. The parties agree to recommend ratification of this agreement to their respective membership (the Township Council and PBA members, respectively).

The terms of the Memorandum are as follows:

1. The term of the successor agreement shall be from January 1, 2012 to December 31, 2015.
2. All terms of the existing contract shall remain in full force and effect, except as modified by this Memorandum.
3. The parties shall mutually create and agree upon a successor collective bargaining agreement from the terms of this Memorandum.
4. ARTICLE VIII – VACATIONS
Modify Section 2 as follows: Each employee may be granted up to five (5) additional personal days per year. These personal days can be utilized only if staffing levels for the day sought do not fall below minimum manning requiring overtime. These personal days must be pre-approved by a supervisor 72 hours in advance.


5. MEDICAL INSURANCE – ARTICLE XI
a. Replace Section 9 with the following:

Effective January 1, 2012, all officers shall contribute to their health insurance premiums in accordance with Chapter 78 of Public Law 2011.

b. Replace Section 10 the following:

Any officer who retires from the Township shall no longer have any health insurance premium sharing responsibilities, except that officers who did not have twenty (20) years or more in the pension system as of June 28, 2011 and who thereafter retire from the Township will be required to contribute to their retiree health insurance premiums in accordance with Chapter 78 of Public Law 2011.
6. SALARY – ARTICLE XIX
Section 1 will be amended to reflect across the board salary increases of 1.9% in 2012; 2.0% in 2013; 2.0% in 2014; and 2.0% in 2015.
Section 2 will be amended to reflect a new salary guide for any new police officer who begins his/her working test period with the Township after January 1, 2012 regardless of appointment date or Academy start date. The new guide for 2012 is as follows:

NOTE: Step 10 of the guide only applies to police officers hired before 4-30-93.

7. ARTICLE XXX – REPLACEMENT AND SEPARATION
Add new Section 5:
In addition to the limitations set forth in Section 2 above, any police officer who begins his/her working test period with the Township after January 1, 2012 regardless of appointment date or Academy start date, or any police officer hired after January 1, 2012 shall have his/her unused sick time pay out capped at no more than $25,000 and paid in accordance with Section 4.

8. DURATION – ARTICLE XXXIV

Change to a four year contract commencing on January 1, 2012 and terminating on December 31, 2015.
