D.R. No. 91-3

Synopsis:

The Director of Representation dismisses a decertification petition filed by certain employees of the Borough of Carteret represented by the International Society of Skilled Trades. As neither the Borough nor the incumbent union objects to the petition and the ISST disclaims an interest in representing the subject employees, the Director finds that no dispute exists and dismisses the petition.

    DECISION

On September 21, 1990, Kathleen Barney, Municipal Clerk, filed an Employer's Petition for Certification with the Public Employment Relations Commission ("Commission") seeking to decertify the International Society of Skilled Trades ("ISST") as the majority representative of a unit of all non-supervisory white collar employees of the Borough of Carteret ("Borough"). The petition was timely filed and is supported by an adequate showing of interest. The Borough does not oppose the petition. After conducting an administrative investigation, we have been informed by the ISST that it no longer claims an interest in representing the petitioned-for

employees. There is no dispute that these employees are no longer represented by the ISST. Since the representation status of the concerned employees is no longer in issue, the petition is dismissed.
