Synopsis:

The Director of Representation amends a Certification of Representative to reflect that the independent Supervisors Association has affiliated with AFSCME Council 73. The Director is satisfied that the organization has met the requirements for a certification amendment and that it has also met the requirements under City of Camden, P.E.R.C. No. 82-89, 8 NJPER 226 (¶13094 1982) to create a separate organizational structure to represent supervisors.

    AMENDMENT OF CERTIFICATION
    OF REPRESENTATIVE

    On August 1, 1994, AFSCME Council 73 filed a Petition for Amendment of Certification with the Public Employment Relations Commission pursuant to N.J.A.C . 19:11-1.6. AFSCME seeks to amend a Certification of Representative issued to Mercer County Board of Social Services Supervisors Assocaition to reflect that it has affiliated with AFSCME Council 73.

    The Commission certified Mercer County Board of Social Services Supervisors Association, an independent organization, as the exclusive representative of a unit of the supervisory employees


    of the Mercer County Board of Social Services'1/ on December 18, 1980 (Docket No. RO-81-121).

    The Supervisors' Association joins in the request to amend its certification to show its affiliation. The Association has demonstrated that a majority of its members, after proper notification, voted by secret ballot on July 20, 1994 to affiliate with AFSCME. The Association has further demonstrated that there has been a continuity of union officers since the affiliation and that the size and scope of the negotiations unit are unchanged.

    AFSCME also represents certain non-supervisory employees of Mercer County. However, the Supervisors Association, affiliated with AFSCME, has agreed that it be and act as a separate organization from any other locals representing non-supervisors. It has further affirmed that this Association, rather than any entity representing non-supervisors, will control the negotiations for and the administration of its contract covering supervisors. Further, the Association, affiliated with AFSCME, certifies that it has no non-supervisory employees as members. City of Camden, P.E.R.C. No. 82-89, 8 NJPER 226 ( & 13094 1982).

    I am satisfied that AFSCME has complied with the Commission's Rules and procedures to secure its amendment of certification. Accordingly, I amend the Certification of Representative to reflect that the exclusive negotiations
