Synopsis:

A Commission Designee orders the Jersey City Board of Education to supply the information requested by AFSCME Local 2262 concerning old and new insurance plans and negotiated with AFSCME concerning the alteration of the levels of benefits and contributions paid by employees for dental care and prescription insurance. If the matter is not resolved the Board shall restored the level of employee contribution for prescription and dental insurance

    INTERLOCUTORY DECISION

    This matter, having been brought before the Public Employment Relations Commission by AFSCME, Local 2262 against the Jersey City Board of Education ("Board"), with the consent of both parties and for good cause having been shown, I hereby Order, that the Jersey City Board of Education supply the information requested by AFSCME Local 2262 concerning both the old insurance plan and the new insurance plan to the extent it has, or reasonably can get, such information in a reasonable time, with a goal of January 9, 1989. This information requested is set forth in Mr. Lehmann's letters to Mr. Massa of November 22 and December 27, 1988. It is further Ordered, that the Board negotiate with AFSCME Local 2262 concerning

    the alteration of the levels of benefits and contributions paid by employees represented by AFSCME Local 2262 for dental care and prescription insurance.

    It is further Ordered that if this matter is not resolved between the parties by February 1, 1989, the Jersey City Board of Education shall restore the level of employee contribution for prescription and dental insurance in the paychecks issued on or about February 1, 1989, to the level paid prior to the unilateral increase announced on or about December 15, 1988, and implemented on December 23, 1988. I will retain jurisdiction of this matter.

    This order is without prejudice to either parties' position and the parties do not waive any arguments they may wish to make in any potential subsequent litigation arising out of the charge. In entering into the negotiations contemplated by this order the parties do not waive any legal rights or remedies they otherwise might have.
