Synopsis:
The Director of Unfair Practices declines to issue a complaint with respect to an Unfair Practice Charge alleging that the Respondent violated N.J.S.A. 34:13A-5.4(a)(1) and (5) and thereby committed unfair practices by not negotiating in good faith with its Board attorney. The Director, noting the factual claim that the Charging Party was engaged in individual negotiations with the Respondent, reiterates previous determinations that an employer's obligation to negotiate in good faith under the New Jersey Employer-Employee Relations Act is limited to negotiations relationships with majority representatives of employees and that the Act does not impose upon an employer an obligation to negotiate with individuals. The Director rejects the negotiations relationship, the Charging Party was entitled to assert collective negotiations rights under the Act.
