    AMENDMENT OF CERTIFICATION
    OF REPRESENTATIVE

    On May 12, 2000, a Petition for Amendment of Certification was filed with the Public Employment Relations Commission (Commission) pursuant N.J.A.C . 19:11-1.6 by Union City Police Superior Officers Association, seeking to amend its Certification of Representative to reflect its affiliation with Local 8A of New Jersey State PBA.

    I have conducted an investigation into the matters raised by this petition. N.J.A.C. 19:11-2.2.

    The initial Certification, issued by the Commission on


    October 10, 1972, designated the Union City Superior Police Officers Association as the majority representative of a unit of all superior officers employed by the City of Union City.

    The Association has submitted proof that a majority of its members, upon proper notification and by secret ballot, voted on February 29, 2000, to affiliate with Local 8A of New Jersey State PBA. The Association has also demonstrated that the composition of the negotiations unit will continue unchanged and that there has been a complete transfer of union officers and members of the unit. Moreover, Local 8A is a separate and distinct organization that will only admit superior officers to membership.

    We have advised the City about the proposed amendment to the Certification and invited it to raise any concerns or objections with us by May 26, 2000. After being granted an extension of time, the City has raised no objection.

    Based upon the foregoing, I find that the Association has complied with the requirements to record its affiliation with Local 8A, and in accordance with N.J.A.C . 19:11-2.6(b)(5), the Certification of Representative issued by the Commission on October 10, 1972 is amended to reflect that the Union City Police Superior Officers Association is affiliated with Local 8A of New Jersey State PBA.
