Synopsis:
The Director of Representation declines to issue a complaint with respect to an Unfair Practice Charge filed by a newly certified collective representative alleging that the employer committed unfair practices by continuing to deduct dues of unit members to the former exclusive representative. The Director notes that procedures for effectuating dues deduction to any employee organization is controlled by statute. (N.J.S.A. 52:14-15.9(e)). The Charging Party did not allege that it and the employer were parties to a collective negotiations agreement which contained a provision, which consistent with the language of the dues deduction statute, would provide that dues be deducted exclusively to the majority representative.
