GRIEVANCE ARBITRATION EXPERIENCE:
Have heard cases since 1987 as arbitrator on various panels--including AAA, FMCS, NJ PERC, New Jersey State Board of Mediation, New York State Department of Education Section 3020-A, New York State Employment Relations Board, New York City Office of Collective Bargaining, New York State Public Employment Relations Board, and FINRA.
Have heard wide variety of NYS Education Law Section 3020-a cases in NYC and other parts of state involving allegations such as verbal abuse, corporal punishment, sexual harassment, insubordination, conduct unbecoming the profession, neglect of duty and immoral character.
Since 2010, have served as panel chairperson on employment-related disputes in the securities industry.

Issues: Arbitrability, discipline and discharge for wide variety of causes including drugs, alcohol, mental illness, theft, sexual harassment, absenteeism and tardiness, fighting and horseplay, insubordination, time-card violations, off-duty misconduct, etc.; non-disciplinary termination, management rights, release time, overtime, wage rates, wage differentials, seniority, promotions, sick leave, personal leave, holiday pay, bonuses and leave for on-duty injuries, etc
.
Industries: Schools, police, local, state and federal government; health care, transportation, trucking, service, storage, chemical, manufacturing, etc.

Permanent Panels: Social Security Administration and AFGE Regular and Expedited Panels for NYC metropolitan area, Northern and Central New Jersey; New York State and CSEA Disciplinary Panel; New York State Education Law Section 3020-A NYC and UFT 2013-14.

MEDIATION AND FACT-FINDING EXPERIENCE:
Federal government employee discrimination claims for EEOC, 1997-99, and as a member of the USPS Equal Employment Opportunity Mediation Panel, 1998-2000.

CANCELLATION NOTICE AND FEE (if any): Adjournment Fee: $1,600 within 14 days of scheduled hearing date. Hearing Time. My per diem for each day or any part thereof spent hearing a case is $1,600. I charge if the hearing day exceeds the amount of 8 hours. Study Time: For each day spent in preparation of the opinion and award I charge: $1,600. This charge will be prorated for partial days devoted to such preparation. Travel Time: (1) When travel time plus expenses exceeds this many hours in a calendar day; 4 hours charge as follows: Travel time (if not time of hearing and travel exceeds 10 hours) (2) I do not charge for actual travel related expenses incurred in connection with the case (3) When the schedule day(s) requires an overnight stay; lodging and subsistence plus one-half day per diem rate.
