NO. 79-16 STATE OF NEW JERSEY PUBLIC EMPLOYMENT RELATIONS COMMISSION BEFORE THE DIRECTOR OF REPRESENTATION In the Matter of NEW JERSEY COLLEGE OF MEDICINE AND DENTISTRY, Public Employer, -and- Docket No. AC-79-3 HOUSESTAFF ORGANIZATION OF THE COLLEGE OF MEDICINE & DENTISTRY, A/W COMMITTEE OF INTERNS & RESIDENTS, Petitioner. AMENDMENT OF CERTIFICATION OF REPRESENTATIVE On November 15, 1978, a Petition for Amendment of Certification was filed with the Public Employment Relations Commission pursuant to N.J.A.C. 19:11-1.6 by Housestaff Organization of the College of Medicine and Dentistry, an affiliate of the Committee of Interns and Residents. That Petition seeks to amend a Certification of Representative issued to Housestaff Organization of College of Medicine and Dentistry on May 22, 1974, with respect to a negotiations unit that includes physicians and dentists titled intern, residents and fellow employed by the College of Medicine and Dentistry, but excluding all full-time teaching and/or research faculty and all part-time teaching and/or research faculty who are employed at 50% or more of full-time by the College and all supervisors as defined in the Act. The Housestaff Organization seeks an amendment to that Certification which will reflect its affiliation with the Committee of Interns and Residents. The undersigned has caused an investigation to be conducted into the matters involved in this Petition. The Housestaff Organization of the College of Medicine and Dentistry has demonstrated that the membership upon proper notification, held an election on October 26, 1978, and voted unanimously to affiliate with the Committee of Interns and Residents. The Housestaff Organization has also properly demonstrated that there is a continuity of unit composition since the affiliation vote, and further, that officers have continued in their respective roles since the affiliation. By letter dated December 1, 1978, the College of Medicine and Dentistry, through the State Office of Employee Relations, indicated that it has no objection to the proposed Amendment of Certification provided that the Petitioner has met the Commission = s requirements for such amendment. In consideration of the affidavit and documents presented by the Petitioner herein including the foregoing, and in accordance with the Commission = s rules, the Certification of Representative of hereby amended and the Housestaff Organization of the College of Medicine and Dentistry affiliated with Committee of Interns and Residents is hereby designated as the exclusive negotiating representative of the employees in the above-described collective negotiations unit.
